Motion for Emergency Custody.
The M.E.C. and the Termination for Custody motions are identical. I know the chance sof getting a favorable ruling today was not good, as those are reserved for extreme circumstances, but at least it supports the urgency I gave my Termination motion.
My motion concerns the emotional state of the defendant to make decisions regarding the best interests of our two children and her and financial stability to support them. I have two police reports of attempted suicide, the last over Easter weekend. The kicker in this whole thiing is that the person that called me about his concerns for the well being of our two children was their witness today! He's about as unstable as her and jumps from one side othe table to the other.
Like I said, the defendant made some pretty damning statements about herself in court and I was able to get their witness to do the same. Now, instead of hearsay, it's on record. My uneducated opinion is that if it were just the defendant and I the magistrate might give some leniency but seeing she had council present maybe not. You tell me.
What I'm asking is that our existing Shared parenting decree be terminated and that I be given full custody, she pay me C/S [neither of us are paying now] and that vistation be limited to the city the children are currently residing. The reason for asking for C/S now is that she has chosen to move out of state [NY] and will likely offer no support with a limited visitation schedule. She has no job, no residence, move away from her kids to live with a man [and his 2 YO] she met this year in a 2 BR apt. She's already had one Motion to Modify denied last year, and that was when she was living here, with an apt and job. Her latest Motion to Modify was dismissed two weeks ago when she was a no-show.
