What is the name of your state (only U.S. law)? GA
Good Morning,
One year ago, June 4th 2010, my wife decided to leave the family and run off with another man to another state (FL). Blindsided me. She left everything, including our son, who is now 13. He has lived with me since she left, and currently still does (except for visiting her last summer, and breaks here and there).
Wife and I are still married, she has yet to pursue a divorce. I haven't pursued her for child support. Why? Don't know. Maybe delusions that she'd come back some day. That's over now.
Anyway, our son is set to go with her to FL next weekend, for his summer break. That was ok with me until I received a huge tax bill yesterday (partly because of her, another story), and I've decided that enough was enough. I want her to pay the past year's worth of child support that she has not paid. We have no court orders or anything like that yet.
My question is this:
IF my son goes next weekend and decides to stay, or wife won't let him come back, can I still file a claim for the past year of child support that she hasn't paid?
I'm tempted to not let my son go with her, however we've been civil about his visiting her this past year. I don't want to feel like I'm using him as a 'pawn', but the law is the law and I want her to pay the money.
