I sued my ex years ago and was awarded a judgement of $5,000. Of course I never saw a penny of it. He is currently on unemployment and did receive a personal settlement of $30,000 a few years ago and I never saw a penny. Now I went to the court and they said it's still in their system but it's basically closed and I would have to pay to reopen it so they can start looking for his monies again. Why is this? What is the best route to go. I know he has monies hidden somewhere.

I would suggest that you pay to have the case reopened.

What kind of judgment? Civil? Child support?

Who is the "they" that will look for the money for you? Because if I'm not mistaken, once you've won the judment, it is your job to seek out and garnish assets/income to obtain the payment. (Unless it is child support, then my answer could be quite different.)

It's civil not child support that's a seperate issue I have with him.

When I say they...they have an investigator that they assign to your case who does go out and look for any monies that he may have. I did get $200 that they found in a bank account a few years ago since then I have gotten nothing.

Like I said: Who is the "they"? Are "they" the court system? Your attorney? Who?

Is it really so hard? If you want them to do more for you, you'll need to do what they want. Beyond that, you will need to do your own asset search.

The court system hires them to go out and look for all of this. I have pretty much no way of finding anything out myself I don't know any good resources

I always thought the plaintiff had to find and file to seize/garnish the assets through the court system.

But hey to answer your question, not in any of the states I'm aware of. The court will grant the judgement and will provide resources for attaching/siezing assets; but the plaintiff has to do all the work.

feel free to call them and ask them procedure for it...they previously sent someone out who found my ex's account and levied the account but since then they didn't find anything. I had to pay for fees and mileage for this through the courts!
