Rights to reside at jointly owned house after divorce?

What is the name of your state (only U.S. law)? IOWA She left hubby & 3 kids and divorce is now final. He is staying in the house until children are out of school, which she also agrees to. When he sells the house he will pay her half of the equity at which it was appraised when divorce was final. Is she entitiled to interest over the next 10 years? Since her name is still on the house, can she legally move back into the house even if he doesnt want her to?

Hmmm wonder why the hell that would change the answer to my questions. But to appease you - here it is:
I have been seeing hubby for 3 months. The wife is threatening to move back to the home. She has given numerous reasons so I am not sure of the real motive. She has a major drug problem and has been arrested 2 times in the last year for drugs. You can forget the question regarding interest on the equity - I don't really care about that. BUT my question asking if she can move back in has a lot to do with me !! It affects my decision to take our relationship to the next level. I don't want to get too involved with someone if there is gonna be drama and negativity and an ex-wife living there.
So do you know the answer as to if it is legal or are you just on this forum to F with people?

So, this is between your boyfriend and his ex, and does not concern you at all. Talk to your boyfriend about the situation and if you don't like HIS answers, that will tell you more about your relationship's future than anything else.

If you dont know the answer - just say so. This IS about ME as it pertains to my life. We have discussed this many times and I do like his answers as they also pertain to me :) HOWEVER I am mature enough to know that I do now want to deal with HIS drama whether I love him or not - she and her drugs will cause huge huge problems in that household and I am not willing to exchange my own personal happiness for it. I try my hardest to stay away from negative people as they are not worth my time.

I was sincere in posting this question - it is really sad that you would use this forum to make people feel bad about asking questions. You would be one of those negative people that I have no time for. Don't bother replying with your immature comments - I won't be using this forum again.

She may be able to move back in without his permission. Depends on the ACTUAL EXACT WORDING OF THE COURT ORDER. However, she will be around constantly if she wants to be because they have children together. If you don't want her drama then don't be part of her ex's life. Because she will be part of his life for ever. Hence, break up with him.

If decree says she gets half equity at which the home was appraised when divorce was final, that's all she gets.

Divorce is final and he most likely has sole possession of the home, she can't bulldoze her way back into the house.

There is likely gonna be drama and negativity if ex-wife wants it.

Please stop giving advice when you don't know what the order says.

We have no way of knowing what the order says (if anything) with respect to possession of the home.
