Do you mean Experian or Equifax?

It didn't show up when I did a credit check, I guess they found this by going to the State to see if there were any liens so I assume that they didn't report it?

I just did my free annual credit check and I had a good credit rating and score.
 


If you went through the Free Credit report company that every one hears advertised you may not have been given the credit report with everything on it. You should check out that Suzy lady and her website. It is a great help and they have forums on how to get this removed from your credit report and what to do with the mortgage company.

Your free report isn't what your creditors see.

Thank you everyone who tried to help me. I went to my lawyer today and we went to the judge. The judge looked at the ruling and the judgement should have been recorded against my ex and that it is not now nor has ever been my debt.

There is still work to be done, I have to wait 20 days for it to be removed and the exe's lawyer can try to contest but the judge is giving me a written ruling that I can take to my lender tomorrow. It has cost me a lot of worry and 2 days of work but I am so relieved.

I would swear that her lawyer somehow made this happen because she hated me and she knew my ex wouldn't pay just by her history with debt.

I've done a lot of research and it seems that after 6 years these judgements can't be challenged so even if it was an erroneous judgement I might have been stuck with it if I hadn't found out about it. It has been 4 years and 4 months and I wasn't really ready to buy a house but my parents nagged me into it, it is a good thing I did.

I'm as high today as I was low before.

Glad it worked out.

Just a couple of things:

1. I don't know about the 6 year rule and you could google it for your state, but usually time limits like that only start when you discover the error. So you should have been OK, anyway.

2. Ask your attorney, but I would consider filing a complaint with the State Bar against the other attorney. It sounds like what they did was entirely without basis.

I feel like I've wasted enough time and money on my divorce and I'm ready to get on with my life.

In hindsight, I remember my daughter saying a few years ago out of nowhere that her mother didn't have to pay her lawyer. I just let it pass at the time but now I really wonder. My ex is very manipulative and I wouldn't put it past her or the lawyer.

I don't have any proof and I'm sure they'd be able to make it look like an innocent mistake even if it wasn't one. I can't know that though. I hope the judge will speak to the lawyer or whoever misfiled it, he wasn't very happy and was very helpful and supportive of me.

I'll get my revenge by getting on with my life and leave them to their own misery.

I closed on my house

I closed on my house today, it is a great feeling. I was remembering coming here in such a panic and wanted to thank you guys for trying to help.

My kids are due in just over a week and they don't know about the house yet, they didn't even know I was looking and it is going to be a surprise.

I think my daughter will be especially pleased because she was going to return to her mother's early to attend a camp and just recently decided it wasn't worth missing that extra 2 weeks with me and because it increases the chances that she will be able to spend a week with my family. She has never had a room of her own when with her mother, she either has to share with her mother, her brother, or sleep on the couch.

My son will be ecstatic, I didn't know how important a place to permanantly call home was until last year when we were at my parent's house and he was grilling them about whether they owned their house. He even wanted to see the deed. He told them he was going to come live with them the day he turned 18.

We talked about it and he explained that with his mother always moving and often forced to move, he just never felt like he ever had a place that he could really call home and even with me we just rented. My parent"s and my brother's homes are the only places that have remained the same in their lives and they want me there but it is the place in their minds that is always home even though we moved when they were 1 and 4.

I didn't just do it just for the kids because in this market my house payment will be lower than a 3 bedroom rental even with taxes and insurance and so we'll all be happy.

Anyhow, thanks again, I've got a lot of work to do in a week.
