How to get it back

My aunt and uncle are 2 of 3 trustees for a house in orange county, california. The 3rd trustee is my other uncle.

The 3rd Uncle's wife handed a form to my aunt and uncle and claimed it was just to see how much they needed to pay off to the bank and my aunt and uncle signed it in a rush :confused: (without reading it. I know stupid move). 3rd uncle also pulled out a loan on the house for 10,000 (we're not sure why or how since his credit is insanely terrible. He's had numerous things repossessed over the years.)

Ended up it signed their half of the house to the 3rd uncle.

My grandmother died and she was the owner of the house but left know will.
The 3rd uncle is now trying to evict my aunt who lived there (and has lived there for more than 15 years). She has been the one paying all the rent even before my grandmother died.

The 3rd uncle moved in after my grandmother died and basically took over the place.

We want the house back and at least in my uncle and aunt's hands. My 3rd uncle has debt problems and we're quite sure he's planning to sell the house.

Additionally my 3rd uncle is pressuring my aunt to move by unplugging her fridge stove washer and dryer. He also removed a door from the hallway to her room (her room has a door but there's no privacy within the hallway for her and her kids anymore). He's trying to throw the family storage out back on the lawn.

Is there anyway to get the house back or at least away from him? I know my aunt and uncle did a really dumb thing but they haven't been doing very well and my 3rd uncle is some what a pest so when he asks things they blow it off.

I think you don't have all the information. It's very clear when one is signing away title to a home. If your aunt and uncle really did NOT realize what they are signing, then it's probably better for them to NOT have any assets.

I would advise that they seek the assistance of an attorney.

Yeah i told them that I don't know if they are as of yet.

My aunt said it was just 2-3 pages and same with my uncle. That's why I'm thinking this is probably more a case of fraud? And I was thinking wouldn't there have to be a witness or notary to it? I guess I'll have to google more but it just doesn't make sense that my aunt pays the house for 15 years and then suddenly decides to hand it over to my uncle.

The wife of my 3rd uncle even got a restraining order (that was dropped) on my mother right when it happened. My mother generally has more reason and sense in the family so my aunt often consults her.

2-3 PAGES and they couldn't be bothered to figure out what they were signing.

They need an attorney, but it seems to me that their own apathy is what caused this problem.

Yeah we've argued but they have been stressed and my 3rd uncle is a nuisance and so they only pity him and help his family. That's why when the wife explained the papers handed them to the aunt, she just signed her name. Not to mention she had to run off to work :\ Yet again yes we did argue about her doing that. My other uncle we're pretty sure he just trusted her and signed them.

So when he comes up to ask things or do things no one takes him seriously. His wife finally got balls and did something :mad: which makes us all mad since they've lived practically rent free for about 2 years.

Thank you for expanding on the definition of apathy.

Their only choice is to consult with an attorney. It won't be cheap, it won't be easy. It may not even be possible.
