When does the divorce clock start? I'm trying to avoid paying lifetime alimony

What is the name of your state (only U.S. law)? California

My question is, I am reaching 10 years this December and am in california. We have been rocky in our marriage (due to me having an affair at which we tried to reconciliate, a few times i threatened divorce since our marriage wasn't going anywhere as a result of my actions and she's comes back crying at me not to leave her). We have 2 kids together, 8 yr old and a 6 month old and one on the way. I don't want to be stuck paying alimony for the rest of my life. If I file today, does that end the marriage today?

I have a friend who said his ex wife messed up and filed at 9 years and 11 months and he got lucky, she didn't know anything about this 10 year rule, he just got lucky, so since she filed at 9 years and 11 months w/o an official judgment from the courts he only had to pay half the amount of years for spousal support, can i do the same?

If you have definitely decided to end this marriage, I suggest you do so as soon as possible. No sense in wasting your time or your spouse's time. Alimony is tricky. It can go either way depending on the climate of the court.

Rip the band aid off and get it over with.

Perhaps prematurely, but because THIS is the exact same situation as a previously deleted thread AND OP's thread wanting to sue his employer for discrimination is exactly the same (except the original thread was a health club or something and current thread is a BIG corporation) as another deleted thread...

I'm sorry, and some may slam me for "being mean", but you, sir? Are slime. IMO, you should pay for your advice. But please send your wife here - I'd be happy to help her.

Well, the divorce can't happen while she is pregnant and since it looks like the baby isn't due until after your 10th anniversary.....if she gets a good lawyer.....

She's stalling to be able to soak you .. lots of women do this .. I know a few who have .. see an attny

I bet she got pregnant right after having the 2nd child just to drag it out - wily woman! Probably stole his sperm while he was sleeping! :rolleyes::rolleyes::rolleyes:

What's funny about these threads is that he's all concerned about paying alimony which is never a sure thing -- and not really considering that he's going to be paying child support for at least the next 18 years. Probably a LOT longer than he'd be paying alimony.

Should've thought about where he was hiding the salami before he destroyed his marriage AND created (at least) three kids.
