What is the name of your state (only U.S. law)? Ohio

Quick run down:

Child support ordered in 2007. Ex made $14,000, I made $8,000. He was ordered to pay $350/month.

Has not been reviewed since.

Ex got a new job in 2008. Asked me not to come after him for more support (he never said how much more he would make, just it would be more). I agreed b/c I knew he was having a rough time getting by (yes, stupidity at it's best).

Last Tuesday we were in court for custody/visitation. He admits he is making $19.15/hr. So roughly $39,000/yr. I am remarried and a home maker. When he filed for change of custody/modification he requested child support be reviewed. I am responsible for the insurance on kids, he is to pay 50% of all copays, etc (I had proof he hasn't). His job is out of the county and the judge asked to see his paystub. He is not paying city taxes where he lives (Judge pointed this out).

Now my question. I know child support will be raised. Will they go back to when he got the job? Go back to when he filed (August 2010) or will the new c/s order start immediately? I guess I am curious as to what the norm is? Judge said it can take up to a month for that judgment to come out.

It can depend. Normally, it can go back to when it was filed; I see he filed like 10 months ago. It won't go back prior to filing date. It could be the date of the hearing.

Dad may also request that you are imputed at least 40 hours @ min wage.

Bear that in mind.

So he improved his earning ability and you made certain you did not? I agree he can and should have a full time income imputed to you.
