I live in North Carolina. I moved here in August of 2010. I originally lived in Virginia my whole life. I live in a home with my father and his partner. My mother is emotionally, mentally and physically abusive. She lives in Virginia. I wish to find a way to move back to Virginia(not with my mother). I have a place ready to take me in. Is there any way I can do this without taking my father to court? My dad and I have had constant court dates with my mother and I don't want to make it seem like I hate him. I don't have a problem with him. I have a problem with his partner. I have been told that I can leave at the age of 16 as long as I have a place to go. Is this true? Please help...

If BOTH your parent agree to this then you should have no problem.

I HAVE to have parental consent from my mother even if she left when I was 12? My dad has primary physical custody and they have joint legal custody.. If I'm moving to VA for college, can she stop me if I'm under 18?

Will you be ENTERING college at age 16? If not, your mother absolutely has to agree to you living with a third party...unless she is found truly unfit for custody. Your father absolutely has to agree.

I'm starting college in February of 2012. I turn 17 in August of this year. Starting college Spring semester. I'm graduating in January. Can she tell me I can't go?

I am honestly not entirely sure on that one. I doubt that she could stop you from going to college, but she can certainly object to you living on campus or in another alternative living arrangement instead of with a parent, until you turn 18. Whether or not a judge would agree with her objection or not is difficult to predict.

It is NOT, however, true that you can leave without parental consent at 16 as long as you have a place to go. Whether you need to have your mother's consent or not (and I am not sure of that either) you DO have to have your father's consent. Absolutely.
