Out of control 10 year old

I live with an out of control 10 year old boy whose behavior doesn't improve with conventional means. He's snuck out through his windows when he's not allowed outside, he's tried smoking, he's on probation for stealing a firearm, going to therapy sessions for sexual abuse from other children and doing it to other children, he hits and screams at his grandma, who is his guardian and is just out of control. We live in ny and I am wondering if it is illegal to lock him in his room for an hour or 2 when he misbehaves and we're at our breaking point. We'll have the windows locked so he can't get out that way and we'll let him out for the bathroom and to eat and when he's good.

New York. He didn't go to jail for it but that's how his grandma explains it to me. He stole a loaded pistol from his mom's boyfriends dad's car and hid it and then fired it off with his friend later on.

He didn't have the capacity to infringe the penal law at age 10 in New York.

Well because of this behavior we'd like to know if we can lock him in his room until he behaves so that he's not a danger to anyone.

I am dating his uncle and his cousin's mother. We all live together.
You should move out. YOU have no place giving this child any sort of discipline. At. All.


ETA: Do you REALLY mean that you're in a 3-way relationship with the kid's uncles and the kid's 1st cousin once-removed? No wonder the kid is so screwed up.

Ya the kids guardian which is his grandma. And no it's not a 3 way. His cousin is my son and I'm dating the kid's uncle. So could I get a stewing answer if it's legal or not?

So, you're his aunt, and you are dating his uncle. Where is your child?

But, I did answer, YOU have no right at all to discipline the child. Perhaps you should call child protective services so that they can get this poor child out of that environment and get him the help he needs.
