What is the name of your state (only U.S. law)? IL

I suspect my wife is cheating on me.She is often late to home after work. Almost everyday after dinner, she goes out to the gym. I know that GYM close at 9pm but shereturns home around 11pm without saying why so late. More seriously almost every weekend after dinner, she goes to dancing (She said) she returns home often 2 or 3am after dancing. There are few time she said she went to something but later I found out she lie. So, I am thinking if I should hire a private investigator to follow her or putting a gps tracking device in her car to locate where she is every night. First, I don't know if this is legal or not. Second, I want to know once she find out this, I want to know if she can apply an Order of Protection against me and the Judge can issue this order? or what possible other legal action she will use against me. Also, I want to know if I can use all the evidence like photos from PI to against her if she did cheat on me

What do you think you can use proof of infidelity for? It won't be considered in a maintenance award or child custody determination in Illinois. Sounds like a waste of time and money.

There is no risk to hiring a private investigator. They know what they're doing and are unlikely to do anything illegal.

However, I agree with the others. It sounds like you've made up your mind to divorce, so file for divorce. If you really must know, go to the gym at 8:00 to see if she's there, but do you really think it's likely that she's at the gym from close of work to 11:00 every day?

It sounds like the marriage has been over for a while. You just never completed the paperwork. If you are no longer having sex, this could lead to infidelity easily. Sometimes one spouse will not leave the other due to financial considerations. Your choice then is to accept the marriage on its terms or divorce. If you pay for cell phones, you can add online gps tracking software to your phones.

What's a tracking device going to tell you that you don't already know? Let's say it says that she spent a few hours at 1200 Main Street in your town. Without invading someone else's privacy, that still doesn't tell you whether she's been unfaithful or not. It could be a friend.

You know enough to know that she's not 'in' the marriage. Time to move on.

Ok, I think I am sure she is cheating on me and sleep with another man. I caught her chatting with a man in town and both admitted they had sex . They have this relationship over 1 year. I am filing divorce. I want to know if I should present her cheating evidence to the court and this will help me fight for my kids' custody. Please advice again. I know IL is no fault divorce. But, one of my friends told me that I should present this so that the Judge will have more sympathies to your side even this is no fault divorce. But I am concerned my wife's lawyer will ask me how I can this evidence. I don't want to let them know the source until the case is over. I think i would rather not say if presenting this evidence is no help to my custody fighting. Please advice!!!!
