Your order states that you need to pay $155 per month to the ex. That's what you pay. He could have paid it off the day after the order was entered and you would STILL be obligated to make those payments.

The order states..exactly this..

"Wife (I am NOT his wife any longer) is to pay the Husband the sum of one hundred fifty five dollars each month UNTIL THE BALANCE OF THE ACCOUNT WAS PAID IN FULL. It was paid off by him 02/2010..and I just found out a few months ago that he paid it off...forgot to tell me I guess.

Hmmm

I will continue to pay but I feel I have a right to a modification due to the change in income.

YOUR balance of the account hasn't been paid yet.

So, you DO acknowledge that you owe it, as you are NOT seeking an elimination of the payments...just a reduction.

Balance is

according to the most recent document filed...1650.00 . I dont understand where they get that number, as I have been trying to contact my X but he wont return my calls.

Included in this figure I assume are attorneys fees and "sanction" feels totaling 1,000 as the judge also ordered me to pay when I made my last payment of 155.00..

Since I can't afford an attorney I have no clear understanding of those numbers.

Then you should start by getting someone to help you with the numbers. That is, start with the original amount and then get a record of all the payments you've made.

Thank you

I will be sending that request to his attorney, requesting a copy or schedule of all payments made...

I hope she responds.

He didn't have to tell you he paid off the account.

He actually did you and himself a favor by paying off the account 02/2010. Otherwise you would be paying interest further out and we all know that these credit card companies stay in business on the outlandish interest and penalties they charge.

You still owe the original amount to him. I advise you to find out exactly what amount is left and get this monkey off your back once and for all. I also advise that you not use anymore plastic money unless you plan to pay the balance in full each 30 days.

THanks

I have no credit cards myself...I don't believe in credit cards after what I went through. NO more.
