What is the name of your state (only U.S. law)? Arkansas....How can my ex wife have my checking account garnished in the amount of 11,000.00 that was transferred by my current wife 6 hours before from her trust fund to pay for her surgery for breast cancer?
How was I made to pay 800.00 in child support for 2 years on top of spousal support of 1200.00 a month making $12.00 an hour?
How can I be made to pay 481.00 a month in child support making 12.00 an hour?

By the way the ex wife is British and has over 180,000.00 hidden there but yet lives here on food stamps and Section 8 housing.
I can't even send my wife to California to be with her sister who just underwent emergency surgery and was found to have advanced cancer yesterday.

Is your wife a dual citizen?

If not, did you sponsor her residency, if she's a permanent resident?

(I'm wondering if that's where the spousal support comes from - the terms of the I-864)

Your checking account could only be garnished if there was a judgement against you. There could not be a judgement against you without you knowing about it...or without you blowing off court. You also could not have a child support order of 800.00 plus a spousal support order of 1200.00 if you only make 12.00 an hour, unless you didn't show up for court...or unless you quit a good paying job and the judge decided to impute a higher income to you.

If you were in arrears for child or spousal support, your current wife should NOT be holding a joint account with you. Her money should have been in her own account.

Wrt spousal support and child support - yeap, it's possible actually if he DID sponsor his ex.

As unfair as it might seem, he could be ordered to support her to the full amount of 125% of the FPL....in addition to paying the standard child support.

When she came here, how she entered the country, when you got married, when you were divorced.

2010 New judge replacing senile judge placed the child support at 481.00 despite my income
7/2011 Garnishment placed on joint checking account for her award for credit card debt in England**************......no notice given**************.....the order did not have an amount or time frame for payment. I was paying monthly against it since judgement was placed.
7/2011 Hearing for garnishment was foo fooed with my lawyer saying after coming out from behind closed doors that "Look, I don't think the judge can legally release any of the money"
Mind you, the money is easily proven to be my wifes placed in the account 6 hours prior to the surprise garnishment when she went to pull the funds for surgery.

So, there is a valid judgement and a valid garnishment order in place...and wifey put a huge amount of money in the account. It's not the system that screwed you... and honestly, I say HOORAY that your ex was finally able to get what she was owed, since you've been working so hard at avoiding the payments you were ordered to make.

I do not have the original order . I sure can get it tho. It basically awarded her this due to her not being a US citizen, my refusing to sponser her, and the inability for her to work to support herself.
