My name is Jeremy and I am from Arkansas. I met a girl a year ago and have been happily with her every since. Her husband was in prison at the time. He used to cheat on her and beat her. He just got out about a week ago and now he is telling my girlfriend that he wont pay anything on the divorce and he is going to try to get full custody of their kid, who I have been raising. I need to know exactly what i should do to prevent anything from happening and I need to know if his threats hold any weight. He says it will be easy because me and her were commiting adultery.. How is it adultery when he is in prison for pounds and pounds of marijuana? Please help me.

He is well within his rights to file for divorce and file for custody of his children. In fact your adulterous GF should have done that while he was in prision before she got together with you. Had she done that, she wouldn't have these issues today.

You do know that these are her issues, right?

It's adultery because she is MARRIED. His crime doesn't change that fact.

Your girlfriend frankly needs to cool her jets with you if this is going to turn into a custody battle.

Your presence - and "raising her child" in particular - could seriously complicate things for her.

Now with that said, if kiddo has been with Mom this whole time the court will likely prefer to keep the status quo.

Really? I'm sure you didn't mean to ask this question. She was married. She had "relations" with a person other than her husband. Where he was located at that time does not make a difference. For example, if he was overseas as a soldier, if he was a cross country truck driver, etc. She needed to file for divorce to end her moral and legal obligation to her husband and to provide a good example of parenting to their child.

Any other questions, your GF would need to post herself.

But...

...it won't certainly won't erase dad from the child's life and Jeremy will have to learn his place as a legal stranger.;)

Your girlfriend needs to seek the counsel of a family law attorney and file for divorce and custody of her child. You are not in any way a party in her legal battles with her husband and the child's custody. That is between your girlfriend, her husband and the court.

There isn't anything that YOU can do about it.

Your girlfriend however can file for divorce and custody of their child and will likely win the case as her husband has been in prison and the status quo is for the child to be with mom. The odds of dad getting full custody are slim to none.

However, dad is likely to get some visitation of some sort, and mom will need to accept that.
