What is the name of your state (only U.S. law)? Texas

IF visitation is not specified in my divorce papers and I am given Sole managing conservator-ship, does that mean that there is no visitation? Also, the other party will not sign the papers and is threatening to make this a long and hard process for me, but he has no lawyer. He says that he is going to try to prove to the judge that I really want to remain married to him and that he needs to order counseling. I do not want counseling at this point and I do not want to reconcile.

My main concern is the visitation of my 9 month old. How can I specify in the court orders that he is to only have supervised visitation and/or no over night stays as my baby does not even know him. He has only seen him 8 times. He has no car, license, apt, or rarely gets paid. He is living in a motel and before that was living in his office for four weeks. He has a history of running with his other child and neglecting him (not feeding him, supervising him, sheltering him). How can I make sure that he does not get him alone? All this could be answered in the above question about if it is not written into the divorce document and it says that joint custody is not in the best interest of the child. And you still had a child with him.

Sorry, but nothing you've said would justify supervised visitation at the moment - or at worst, it would likely be supervised for a short period (reintroduction/reintegration) and then Dad would get the regular visitation schedule for an infant.


It's unusual for a divorce decree to NOT address visitation. Is this something your attorney is suggesting you do?

If your ex won't agree, then you have virtually NO chance of "no visitation" being ordered.
