Splitting Expenses in Addition to Child Support

What is the name of your state (only U.S. law)? LA

My child support has been hit or miss this entire year. Sometimes I get it, sometimes I don't, sometimes it bounces. I am actually in process of filing a rule for contempt for several issues and have a question about the child support. I am attempting to seek an ex parte order for a wage garnishment through his employer. Do I also have the right to seek reimbursement for 50%of her recreational activities, school supplies, uniforms, summer camp, and any expenses for recreational travel out of town?

You can seek reimbursement for expenses that the court order allows you to collect. If it's not in the order, you probably can't collect. In general, CP is responsible for most of those expenses unless otherwise ordered.

As for the rest, have you talked with your child support enforcement agency? That is often the easier way to go. They can handle the garnishment order, etc and save you the trouble. The cost is tiny.

Is there an order for the NCP to pay for the recreational activities, school supplies, uniforms, summer camp etc..
 
Thank you for the replies. There is nothing in place currently in our order. I was going to see if I can add this in when we go back to court, if we go back to court. I was not sure if I could or not and have never asked him in the past to help me. Since he is not paying child support I asked him to split the recreational fees, uniforms, etc.. and he denied me. One of my friends incorporated this in her order, so I figured it is worth a try. I will certainly go through the state for Child Support. I appreciate the tip! I need to clarify that I am going back to court to modify our order and wanted to know if I can ask for expense reimbursement for extras.

You cannot ask for the money for these items retroactively.

You want your X to pay for your child's vacations? :rolleyes:

School supplies are normally on the custodial parent. That's what CS is for: to reimburse the cp for a portion of the expenses of raising the child in their home, including schooling.

Recreational travel activities. Perhaps is on a competitive dance team, gymnastics team, soccer team, etc. Perofrmances, tournaments are often out of town and/or out of state.

I think that is what she meant as well.

I think that summer camp, if its a daycamp because she needs summer daycare is something that would likely get added. All of the rest of the stuff she has mentioned are very iffy.
 
She is on a competative traveling sports team. We travel to Florida, MS, and TX for tournaments. We have about 3 or 4 tournaments a year. We agreed that he would exercise 3 weeks of summer visitation 4 years ago. To date, he has not exercised 1 week, or even a weekend in last 2 months. He backed out at the last minute and I had to find camp immediately for her during week. I would like for him to split these costs with me during the summer, and should he exercise his summer visitation, i would certainly split the cost with him if he puts her in camp over there. I am not looking for retroactive pay. I would just like to modify the order to include this moving forward. Thank you again everyone.
 
Unfortunately, I have made several attempts to contact him. This is her first year traveling, and he will not return my calls, emails, or text messages regarding visitation, child support, and expenses. I have had no contact with him in 2 months, which is why I would like to modify the order. He has not contacted our daughter either. His wife tried to email me and I asked her to have him call me so we could talk about it. There is a clause in the order that she is not to interfere with parenting our child, and if he can't talk to me and be civil, I don't know what else to do. So I guess when I go back to court and ask for a split on expenses the judge could either say yay or nay. I just was not sure if it would rub the judge the wrong way to ask since I never asked in the past.

Have to be frank and tell you that I doubt Dad will be ordered to pay towards school supplies or the traveling expenses. Camp is possible since it is technically "daycare" expenses and perhaps the school uniforms will also be approved.

Since you noted that sometimes the support "bounces" it would appear that perhaps Dad is struggling financially. So although that doesn't excuse Dad from support, if Dad makes a case for financial struggle, it may make the judge less likely to order anything over and above.

Of course, all the judge really can do is say no.

I have had no contact with him in 2 months, which is why I would like to modify the order. He has not contacted our daughter either. That's true.

However, I'm a big believer in only asking for things that are reasonable. IMHO, it's unreasonable for CP to expect NCP to pay for everything.
