Legal Annulment of a domestic partnership

What is the name of your state (only U.S. law)? California

My partner and I have lived apart for over a year now and I have tried unsuccessfully to annul our partnership. In July of this year, we had a argument that led to him putting his hands on me and the police were called. He went to jail that night. I waited for a week to speak with him about getting an annulment of our partnership, and he still wants to wait in hopes that we will reunite. I have also learned recently that he is still legally married, also in the state of california, which I thought would automatically make our partnership null and void. Bottom line is, since we no longer live together, can I still get an annulment of our domestic union without his signature on the documents? We do not have any joint accounts, children, property or things that could legally tie us together in court. I just want to move on.:(

No it is not a same sex partnership. What does the age have to do with this?

I think that you need to speak to a local attorney who has some experience with domestic partnerships. Even if you cannot afford to hire one, I think that you at least need a consult with one.

I agree. Marriage annulments are pretty well understood. I'm not sure that the case law for annulment of domestic partnerships is all that well established.
