What is the name of your state (only U.S. law)? Texas


I was wondering if my fiance and I are free to get married, or what we would need to do to be able to marry here in the US.
Her situation is, she is not a US citizen. Over a year ago, she met a US citizen in her country, and they went on vacation to Jamaica and ended up getting married there. She returned to her country and the guy came back to the US. He ended up getting arrested, has tax problems, money problems, and lived out of a car for a while. She has not seen him since they were in Jamaica, and only saw him for about a month.
He has since said he will not divorce her at all, even though she want nothing more to do with him. She and I are ready to take the next step in our relationship and begin our lives together.
Our question is, how might she finally get a divorce from her husband (or does the US recognize her as married?)

Oh, she's legally married, absolutely.

So she'll need to divorce him. In order to do that, she'll need to find him.

Where is she living at the moment? US? Her own country?

She lives in Russia. She has contact with him, and has asked for a divorce several times, but he refuses to divorce her.

Then she'll have to file wherever he lives.

She doesn't need him to consent to a divorce; but she will need to have him properly served etc.

I am truly wondering though, why he would be so against a divorce.

You are getting all of the details, yes?

If HE lives in the US, and OP wants to bring her here and get married in the US, then russia doesn't have to do anything. She can hire a lawyer in whatever state he's in to file for divorce there, and once it's final she'll have the divorce decree to present when she files for her new marriage license.

If the marriage will be taking place in russia, then it's russian law you have to worry about.

Did the story of the marriage come out only AFTER you two had been "dating" a while? Like about the time you wanted to marry her?

How much money have you sent to her (no, I don't expect you to really answer this question)... and how much more does she say she needs for the divorce of a man that loves her so much after a month?

You are being scammed. She is going to hit you for help with legal and living fees, travel fees, etc. All of which she will NEVER show you a receipt for... and you MAY get that month if you buy her a really expensive vacation.

Maybe.

Tell me you have a least met this person IN person....

I appreciate your "concern", but I came here looking for advice.

I have sent $0, she told me the 2nd day that I met her. Let me tell you who got scammed, she did. She helped pay for her vacation, she got lied to, she was the one stuck with a loser that evades taxes and lives out of a car.
Some people just make mistakes every once in a while, and that was hers.

I'm not just some American guy that's hoping for that hot Russian bride. I lived out there before, I know people out there, ect ect.

Fine.

Then ask for a copy of the marriage license. It should take you about 15 minutes of Google work to find out if it is valid and then to find the husband.

Now, have you actually met your Russian friend? In person?

Yep, if he isn't getting setup for the give me money please game, its gonna be the marry me so I can come live with you game. That one ends with her getting us citizenship,claiming he beat her and taking him to the cleaners in exchange for not prosecuting. She must be one loose woman to have picked up 2 amercians so easy.

My next suggestion, of course, was going to be to reach out to the husband and talk to him about their mutual love connection.

She met, vacationed with, married and is now divorcing the LAST guy all within a year... and notice that her ardor cooled with the hubby's financial situation.

OP... keep your job. Apparently, your love life depends on it.

Her ardor cooled when he was trying to pick up other girls, trying to make her have 3somes with him and another girl, and when she found out he lied to her about his financial situation, which she found out after he came back to the US, went to jail, she didn't hear from him for over a month, and finds out he's basically a hobo. I think most girls, Russian or not, wouldn't want to stick around.

I came here for advice, not for bashing and assuming that I am the typical American guy that is grabbing a mail-order bride.
We met at church, she was wanting to stay in Russia and help her sister with her kids and keep her photography job.
