What is the name of your state (only U.S. law)?
Cali

Hi, I have been maried for 5 years with two kids. I work for a corporation and my wife is seld employed. She was diagnosed with MS (multiple sclerosis) last Feb. of this year. She has insurance but it does not cover jack. Her medicine alone is about 5k a MONTH, and the hospital bills are staggering. To ad her onto my insurance is very expensive. Someone told us in order to get her the medical attension that she needs is to get a divorse. Beeing a single mom with two kids will qualify her for government assistance and free medical/medicine for her disease. My question is, is this really my last option. Will this work? Is there anything else I should know about? Is this a bad idea? As a husband and father, i feel helpless not being able to do what it takes to get her medical insurance. I work full time and pay my taxes and live paycheck to check.
If anyone has ideas or segestions please feel free to comment.

Has she applied for SSDI/SSI?

I'm concerned that if you go ahead with this plan and she goes on State assistance, the State will look to you for reimbursement.

Really? I can understand if the kids were sick that the state would want the parents to pay, but an ex-wife?

She did apply but she was denied because our income was over 40k.
I think 40k is the threshhold. If we get a divorce, she will not have income and that would qualify her for assitance.
Come on guys i need more advise. Other than the tax benifits of being married is there anything else we would be missing?

Yes, the fraud issue. If you divorce solely for her to obtain benefits and then continue to live as if you never got a divorce, you have committed fraud.

Then there's the moral issue. Is it right to saddle everyone else with your expenses simply because adding her to your insurance is expensive?

As has been told to me many times in the past, "this is a legal site", your personal non-legal opinion should expressed at moral_viewpoint.com.

Wow. Just wow. The potty mouth OP here.

OP, one more thing to consider as you consider committing fraud. As her husband and a part of her family, you have the ability to access your wife while she is in hospital as a family member. The right to visit and have access to your wife when she is hospitalized (and potentially have a role in her care) may/can be severely restricted when you cease to be her family. Since MS is a slow degenerative disease, this may have significant impact. And if her family (mom, dad, siblings) decide they want to exclude you from her medical care after you divorce, you may find yourself regulated to the same role as a neighbor. Can you live with this? In addition to the theft/fraud issues.
