my ex received my divorce papers at her address, she opened them and then held onto them. then she put them into another envelope and sent them to my p.o. box, by the time i received them it went to default.
she also told me she opened up my W-2 statement from my employer and took a copy of it to the courthouse and also shared that info with others.
she also told me she opened up my tax refund check because "i just wanted to see how much you got back" (it was only $28)
she is asking for $5500 to pay off her/our credit cards
we were together in 2010 and she filed her tax return in 2011 and got back $4400,
shouldn't half of that go towards the bills?
if i hire an attorney can he get it dismissed for her tampering with my mail?

why hadn't you ever put in a change of address with the post office, and made the change with the IRS and your employer?

what have you ever done to make sure your mail gets to you only?

Yes, an attorney MAY be able to get it dismissed due to lack of proper service. However, you should do the math to see if the potential savings are worth the expense and time.

However, I would also file a complaint with the Postmaster General. She has committed a felony (several, in fact).

i did that princess, if you read my post SHE mailed it to my p.o. box
unfortunately the post office sometimes still delivers mail there and yes i did have a po box when she received them.

another 1 was from the unemployment office, it was a bill for $300 over-payment
and that one she was KIND enough to open scan and e-mail it to me.
the actual bills were $1100 in credit card debt and she wants half, but after we separated i continued to give her money and i want her to credit her tax return to it, my main thing was that i never had my day in court. and because she held onto my mail i automatically lost

You would have been responsible for 1/2 of the marital debt whether you were present in court or not.

So if the marital debt is the only issue, it might not be worth it to spend money on an attorney to take it back to court. If there are other issues, that might change things.

Whether or not her tax refund would have been considered as a marital asset depends on the timeline.

OP, google Epstein credits for the payments you made to her that should have gone to the bills.

Also if the tax return was filed as married joint, then you could return to court to ask that the money be split in half after the marital debts were paid.
