Hello- My Mother and Uncle co-own a summer cottage property after inheriting it from my Grandparents. For 11 years my Mother has tried to get my Uncle to agree to necessary maintenance upkeep on the property. He will never commit to more than "band aid" solutions which has resulted in the property depreciating significantly over the past years. He claims he is in a poor financial situation and will not assist in his half of the maintenance that contractors have recommended. He is a real estate/family estate lawyer and she is concerned he knows something legally that she isn't aware of. My mother does not wish to see her asset continue to depreciate. She has offered to buy out my uncle several times, with the understanding that he and his family can always use the property during agreed dates. He acts offended and strongly says "never in his lifetime". Does my mother have any legal rights to get him to commit to upkeep or get him to sell? This is a very special piece of property to our family and it is a very distressing situation. **A: the answer is yes but mother needs to level the playing field by hiring her own lawyer. She is afraid because this guy is an attorney.
