Hello forum, I searched around a bit, but was unable to find any information on cases similar to what I'm facing.

Here's my story, please offer advice and/or let me know what I can expect as far as punishment goes.

I was at a bar close to my house here in Kentucky and had a bit too much to drink. I got on my bicycle and attempted to ride home. Unfortunately a police office saw me swerving and stopped me. I failed the field sobriety test and went to jail. I blew a .28 (yes, I had quite a bit to drink) and spent the night. The next morning I was released and have a court date set. I've never received a DUI or drug related charge before.

The real kicker of the story, and the root of my worries, is that I had about 3 grams of marijuana in my pocket which I quickly told the arresting offer about and never attempted to hide it.

Am I facing jail time? Probation? Fines? I can't find any clear cases regarding DUI/DWI on a bicycle, but from what I have read, the state of Kentucky classifies a bicycle the same as any vehicle when it comes to DUI.

As a note, I'm not sure if it will count for anything, but I am a college student in very good standing, 26 years old and work a full time professional job. I just made a really bad decision.

Yes. you can get dui on a bicycle. My cousin got one on a horse. He fought it and lost, because the horse knew its own way home.

You can expect jail time, probation, fines, and court costs. You may no longer be in good standing with your college or your job.
