Custody of a minor child

What is the name of your state (only U.S. law)? Kansas. I was wondering how I could get custody of a minor who is not related to me but we know each other from my 13 year old . The girl I would like custody of is 13 and lives with her legal mother and her legal father is in prison. Her mother remarried and had kids with an abusive man. He is only abusive to the mother but the child I want custody of has seen the abuse several times and is scared to death of him. She did actually have the state get involved and the child lived with her aunt for a short time because she don't trust her mom and doesn't want to be aaround this man. She sees a counselor and she told srs (the state) her counselor she is verry afraid of this man and wants to live with me because she trusts me. Her mom is very flaky and keeps contuining to put her around this man. What can I do to obtain custody of this child?

You have no standing to sue for custody of this child.

The State has been involved and has seen no reason to remove the child.

the only way YOU would get custody, is if mom AND dad agreed. just because dad is in prison, doesn't mean he's lost a say so.

if the child is scared, she can speak to her therapist. if her therapist is reporting actual abuse and not just the child's fears, the state will intervene. and family members will be contacted. not you. you are not even on the list.
