Divorce while pregnant

I need to get a divorce in Ohio. I am pregnant, and while looking online, I saw that you cannot get dicorced in Ohio if you are pregnant. I wanted to know if this is true. If it is, is there any way around that? Two months ago, my husband got arrested for a domestic violence case, in which I was the victim. Would that help me be allowed to get a divorce? Please help. I really want to get divorced before the baby comes so I can establish custody.

Not happening, I'm afraid.

The State will want you to wait until the child is born before they'll allow you to finalize a divorce.

(In other words, they don't want to b a s t a r dize a child)

(I hate that the site edits that word - it's a valid term)

mom. i really think you need to calm down and educate yourself. i'm saying this to be nice, not to pick at you. so please don't take this as a lecture.

being divorced before a birth will not stop dad from being a dad. he'll just have to jump hoops higher. so what you are trying to do is a waste of time anyway.

now, once the child is born, you will have status quo of physical custody of the child. unless you forgot to tell us you are a drug addict and a harm to the baby.

throught the divorce proceedings, it will be established best interest of the child. being the child will be living with you full time by the hearing, most likely you will have a majority of the time. normally, anytime that doesn't happen, is because you did something really bad. however, this will not stop dad from being granted visitation. overnights included. breastfeeding will not stop dad from having overnights.

a schedule will be set. joint legal custody will be implemented.

if the ex is charged with a crime, a restraining order issued, then there are safety measures you can ask for.

you can request a third party exchange. you can request a police station exchange. at the beginning, supervised visitations may be requested, ask for a third party to do so. or at least be present.

YOu cannot get a divorce in Ohio while pregnant. That will have to happen AFTER the baby is born. HOWEVER, there is statute that takes into consideration DV against a family member and how that affects custody. Calm down. Dad will still get visitation regardless of anything.

how would they even know you are pregnant unless you look like youre ready to drop?
So are you suggesting she lie when asked if she was pregnant? If she did lie, she would have issues later on as that would be considered fraud upon the court and her husband could use it to reopen EVERYTHING. Not to mention the court could sanction her for her lie and she would lose credibility regarding everything else.

That is a common question asked in every uncontested divorce I have ever been a part of in Ohio. I have had clients 60 or 70 years old asked if they are pregnant.
