Changing Custody

What is the name of your state (only U.S. law)? Illinois

I was mis-represented and my former lawyer just gave my ex sole custody and now it is haunting me in every situation. How difficult is it to get custody ammended?

My ex is mentally abusing the children and not cooperating with the co-parenting agreement. I need advice on making changes so she does not hold all the power moving forward.

The kids are just four and six, and I am concerned about their mental wellbeing due to abuse by their mother. Because they are so young, the abusive behavior is difficult to prove and hold up in court.


Please help!

Unless there is compelling evidence that there is emotional abuse, it's not likely that you can change custody.

And please explain what you mean by your attorney "gave" Mom sole custody?
 
When I say "gave" custody, that is in reference to there being no reason for my lawyer to agree to sole custody and didn't know what that meant legally. No drinking, drugs, abuse, or cheating when we separated; and am at the mercy of a very unreasonable person here.

She has made statements such as "I hope the baby dies", in reference to my current wife being pregnant. And I can't get access to their school work? ... pretty messed up system!

If you could, please type word for word - minus names - what your actual custody order says.

Yes you can. Who says you can't get access to their school work/records/teachers?
 
The Parenting Agreement states that she "is hereby awarded the sole care, custody and control of the parties minor children ..."

When I mentioned "school work" versus "records" that was in reference to the their homework, projects, and worksheets that she is blocking me from. I am receiving that basics as called out in FERPA, but that is it. That was different last year, but now the school has changed their position due to my ex's request. My ex refuses to discuss the issue or explain her concerns with my involvement in their education.
