What is the name of your state (only U.S. law)? Nevada
So, I'm not sure if this is the correct forum, but I'm in a dilema. I'm a very principled person, and only try to do things right, but hate getting bullied. I own a vacation home in Las Vegas, I had a lawyer request to book my house, I require a $300 deposit to book it because it weeds out the serious people that wants to book my house. Anyways, she canceled, but I also have a disclaimer that the deposit may be forfeit and / or a minimum of $ 100.00 admin fee unless they cancel within 3 days. It was past that and I offered to give her a break and only charge her $ 50.00 and refund her the remaining amount. She's now threatening to sue me for the $ 300.00 plus her attorney fees and costs. She even mentioned a class action lawsuit. Her wordings are very aggresive and I'm at wits end trying to figure out what to do... I don't like to cave in, it's the principle of the thing for me... I'd rather spend a thousand to file a ethics complaint against her then give her the full $300.00. BTW, I am considering crediting her the $ 250.00 and see if she'll go the extra mile to file for the measly $ 50.00 (her words).
I also wonder if there is a minimum discrepency amount to file a lawsuit...

Did they actually sign a contract with this statement?

Send her written notice that the deposit is being held per the signed contract.

**A: refund the money since an attorney can file a lawsuit for free and it will cost you more. By the way, the class action stuff is a bunch of bs.

If she files in her state, is it worth the $100 to fight it? Grab the bull by the horns. It may not be worth her time to fight it. I would make sure I had the policy clearly accepted.

Call her up, laugh at her, and then ask her to look up the definition of a class action suit and call back with results. Like many attorneys, she's trying to impress you with her knowledge and got the predictable result: FAIL.

the threat of a class action suit means she either has no idea what she is talking about or is throwing everything at you she can to scare you. For her to attempt to mount such a suit, there would have to be multiple plaintiffs (don't know the number offhand) that would be eligible to be part of the suit due to being damaged for the same thing. Unless you have done this many times, it is simply an impossibility.








as to the rest: is it worth the hassle even having to respond to a suit for the little bit of money involved? If you have lost nothing other than a little time, it would be in your best interest to simply send her her money and be done with her.

It costs nothing to file a complaint against her with the bar of her state of licensure.

Seriously?! With her threat to file a class action suit I wonder if she even is an attorney..As justalayman said there are numerous plaintiffs.. Call her up and laugh at her..wait post her number we can all call her and say this is our idea of a class action suit against her!

**A: all she has to do is call another friend attorney and tell him or her to do the same thing. When you take the same action, the 2 bad attorney's would constitute a "class"
