What is the name of your state (only U.S. law)? ohio I live in small village that is not zoned or no codes in the county...I am wanting to refinance my house so the bank sent an engineer to look over property to make sure house is build where should be in the process he found that my attached garage is 6 ft over on the set back..I live on a dead end street that turns and only one using this small street is my neighbor and i for our driveways then the street goes into a field...I wrote a letter, my engineer wrote a letter, asking for a variance when I went to the council meeting they had a letter from their lawyer and he basically said I need an easement and then ordiance...so the mayor wouldn't talk about it with the council and come to find out she didn't even give them all the stuff I had handed in...I honestly think they don't know the difference between a variance and easement...they just tell me to get a lawyer I called 2 lawyers and told them and they say I don't need a lawyer to ask for a varience I am at wits end dealing with these stupid people

**A: you need a lawyer to deal with the stupid people. Actually there are legal issues involved and specific procedures that need to be taken. You need to find the right lawyer willing to take the case. The matter is simply not as easy as you think it is. It appears that you need an encroachment agreement.

in overlaps the encroachment..where I lived before we had to get a variance cause of a common drive and all we had to do was go to the township trustees and they presented it to the zoning board and that was it we didn't need no lawyer...the 2 lawyers I talked with and this is some of what they deal in both told me it's a simple thing I didn't need a lawyer to do anything I could write it up myself and even the engineer wrote up asking for this...I think they are making too big a deal out of this..I don't need an ordiance casue I'm not asking for a law and it already is in the easement so I don't need another easement...beleive me this mayor knows nothing just some housewife who decided to be mayor
