What is the name of your state (only U.S. law)? MA
I bought on 9/3/11 a 07' Hyundai Sonata Limited Edition. This car had a sporty effects kit on it. The girl who sold me that car specifically mentioned this effects kit was not aftermarket, that it was factory installed by Hyundai, and was due to this car being a Sonata Limited Edition model.
Recently I noticed this effects kit, coming apart from the front bumper on my side, and the passenger. I called Hyundai USA, told them what the sales woman told me about this effects kit, they checked their information systems and found no mention of an effects kit, nor any part numbers for any such parts.
I then took my car to a bodyworks shop, not some rat shack, a real body shop that does work ala American Restoration lines, real professional work. They took a look at the effect kit and confirmed what Hyundai and my own thoughts were, that this kit was indeed aftermarker. And, installed inproperly which in turn may have caused more damage to the car.
I originally wanted to get the front bumper fixed so that it was attatched properly, until I heard from the body shop. They said they would personally advise me to have the whole kit taken off, front and back bumpers and both side panels, and replaced, with genuine Hyundai parts. They gave me a visible estimate of closed to $3k. And mentioned it could be even more than that once they take off this kit and potentially find more damage to the car due to the improper installation of the kit.
So far, I called the dealer I bought the car from and am waiting for a response. I am no legal expert, and was wondering if the dealer should pay the repairs or if by law they should. I also am curious if by the law, I would be entitled to a refund of this car and canceling the contract as I was clearly lied to, and have two people who were with me when the sales woman lied to me about the kit.
If anyone could help me out I would greatly appreciate it.
