What is the name of your state (only U.S. law)? FL
I'm the trustee of my grandfather trust and selling a condo that is in the trust. The agent has my name alone on the listing agreement. My question is should be the name of the trust and myself acting as trustee? I don't for see any issues but if something goes south and the buyer or someone else wants to sue I don't want myself being the one being sued, would rather the trust be. I might be looking into this to much just trying to cover my a$%. What do you guys think?

It should be you as trustee. You personally may already be bound with the agent, but I'd certainly re-write the contract. Your real liability here is with the agent, try to get him to agree to the change.
