Child Custody Case Possibly

What is the name of your state (only U.S. law)? Virginia

I just recently left my husband and now we r back together we seperated for 2 weeks i moved back n and asked my mother to keep the kids until things settled down. I wanted to know can my mother prove me unfit just because i left my kids n the care of a registered sex offender(i knew of his charges), not child related. Is there any way possible she can prove me unfit i have been told several different things just talking with people i need help. My mother will not give my kids until me n my husband seek professional help. Legally she cannot do this we see our kids everday after we get off work. She said that she can prove me unfit and my husband for the choices we have decided to make recently before or break-up and in the past. She says that i dont give my kids their medicine regularly which they have asthma they need their medicine seasonally. Also she states that the old baby sitter has documented that my husband and i brought the children to her dirty which is not the case my children stayed inside the home of the babysitter so we threw them on clean stained play clothes we figured they were gonna get dirty anyway they always came back to me with new stains. I bath my children regularly. I do not believe that my children need medicine i have tried taking them off and they did fine n then she put them back on their medicine n my husband also smokes pot occasionally not around the kids is all this bounds for being unfit. my children are clothed, fed, we read stories to them every night and we also play with them n we dont argue in front of them. i need answers.What is the name of your state (only U.S. law)?

i'll need answers to my questions. who is the registered sex offender? is your husband ALSO the father of the children?

are there any court orders? did you sign over guardianship to your mother? custody? how long have they been camping at grandma's house?

Isis asked all but one of my questions. Be honest, please. Did the doctor tell you the medicine was only needed seasonally, or did you notice they only have problems seasonally, so you give it to them when they need it?

husbands friend yes my husband is the father of my children , my husband and i have joint custody of our first child n are going to court n november for joint custody of our second child, no i did not sign over any guardanship to my mother nor custody since sept 23rd of this year

i am being honest i have nothing to hide......beginning of spring they take their allergy medicine n the asthma medicine is as needed

one more time, how long have they been AT grandma's?

and what is stopping you from picking up your children right this minute? and is dad in agreement with this arrangement? are you living with your husband right now?

and why are you leaving the child with a sex offender??? the BOTH of you???

i answered ur question no need to get smart im asking for answers not attitude.....since sept 23rd i see them everyday....yes my husband is in agreement with this so that him n i can get marriage counseling...because i am not risking losing my children i have been told if you lose custody it is very hard to get it back what im asking is it against the law to leave your child with someone that ias a registered sex offender non child related??? n i dont have other arrangements for childcare she offered to babysit while we both worked n my ldest is going to a school in her zone....uumm because his charges r not child related klike i said before if i thought for a second that he would harm my kids i would not leave them with him he is no lonegr in the picture anyway

n yes i am living with my husband right now my mother is threatening me n i dont want to drag my kids through court or custody battle my mother knows alot of people and can pull strings so im asking for advice n answers

actually, you stated you hadn't signed SINCE Sept 23rd. your lack of punctuation makes it hard for the rest of us to decipher.

want to shut mom up, go get your kids. NOW. with birth certificate AND id's. both you and dad. the more time they are there, the more ammo you are giving her.

is it against the law to leave your child with a sex offender sitter? no, but it sure is questionable. simple solution, don't do it again.

if you and husband cannot have the children around while fixing your marriage, then one of you need to leave the home so the children can return home. preferably, the pothead should leave.

Isis was serious, and it was exactly the correct advice. You need to go get your children NOW. Not in a week or a month. Bring proof that you are their mother. Bring their father. If she won't give you the children, call the police. They are your children, and if there is no court order that states otherwise, you have every right to take them NOW. Do it, because not doing it helps your mother establish certain things that could be helpful to her in a custody battle. GO GET YOUR KIDS. NOW.
