Is it considered Statutory Rape & what can be done?

My question is: I was born May 31, 1981, the man I was with was born on December 25, 1975. We had a daughter together on March 20, 1998. Would that be considered Statuatory Rape & if so what is the statue of limitations on something like this?What is the name of your state (only U.S. law)?

This was 13 years ago ... why is it an issue now? Why would you care to go after him now? Some sort of revenge?

Depending on his relationship to you, this may not have even been a crime.

I'm not sure that statutory rape exists as a crime in NJ. The crime you are alleging appears to be sexual assault.

In NJ, there is no statute of limitations on sexual assault. However, the fact that you waited so long will call your credibility into question. At least you won't have to worry about evidence since the child's birth proves that sexual activity occurred.

I am thinking along the same lines as cdw. Why are you just making an issue of it now?

Well 1st of all after having our child he left w/ my child 2 bring my child 2 his parents 2 raise but I couldnt prove it then. He has been making my life a living hell w/ Child Support 4 10 yrs now. When a juvenile commits a crime b4 the age of 18 it is swept under a rug but I have a child under 18 and I am paying dearly 4 it 4 many yrs now. I am not saying that I am not responisble 4 my child but 4 over 10 yrs now I have not been able 2 hear from my child, they have kept her from me, there is no reason 2. It's against court order 4 them 2 be doing that.

Why is this a concern now, and not 13 - 14 years ago when it happened?

OP was 16 when the child was conceived. The OP has shown nothing to make us think that this was even a sexual assault.

You're right. I should have said that the closest crime to statutory rape was sexual assault.

In NJ, it can be sexual assault if the child us LESS THAN 16 years old. Since OP was 16 (unless the pregnancy was more than 10 months), no crime was committed.

You couldn't prove that he took his child and had the child raised with his parents? So, are you saying that his parents concealed the child from you for 13+ years?

Had you made a child stealing or kidnapping report with the police?

Or, are you saying that he took custody of the child and you did not or were unable to fight his custody at the time?

Why didn't you go to court and ask for custody? If you do not have custody, it may be because there is something about you, your lifestyle, or your capability to raise the child that is an issue.

If the father is violating the court order, report it to the police or to the court as appropriate.

Unless there was a relationship that put the adult in a position of authority over the OP ... which is why the question of their relationship was asked initially by OHRoadWarrior, I imagine.
