What is the name of your state (only U.S. law)? California

I got a speeding ticket from CHP and am in the Process of fighting it. I fought and beat 8 speeding tickets in TX on failure of the state to lay foundation for RADAR evidence(I.e. No calibration or training records brought to Ct)

My question is, what is Cali's RADAR evidence foundation law? Besides the requirement for the state to Present the units calibration log and officers training Certs, is there anything else? I don't do the whole discovery process. Too time consuming, plus it's the govts burden to prove it's case and the admissibility of it's own evidence.

You'll find California is a far cry from Texas. They'll have all the foundation they'll need in the court room. One thing you should investigate depending on what you were cited for and the type of roadway is whether the SPEED TRAP LAW requires a traffic survey and whether that meets the requirements of the law.

Based on your posting history, may I suggest that you utilize public transportation in the future? It would be much safer for all involved.

I concur with both replies...

As far as foundation, and CHP testimony in court, you're wishful thinking. EVEN IF it was a speed trap case, you'll usually find that the CHP is current on all requirements, and their officers are well aware of what elements their testimony must include.

Think of another defense!

The state still has to meet the foundation requirements in court; they may be able to with proper testimony.

You can always object & get a ruling.

Foundation requirements can apply to both testimony & documentation.

Foundations require concrete. This should work well since you're such a block head.
