Here is the situation. My child was enrolled in a school in Atlanta, GA for August 2011. There was an incident that happen while she was in school. The teacher claimed my child kicked her after physically tried to stop her from walking out the class, (which is what I told my child to do if she feel threaten). I never received any paperwork from the school about the matter, only a call from the teacher. I was told no one was sure about what happen. I requested to speak with the principal many times, but she never responded to me. About a week later this teacher started calling me. She made comments about taking legal action if I don't talk to her face to face. This went on for several days then I call the school to speak with the principal again, asked about the incident again, and to find out why this teacher was calling me. The school called me later that day and stated they dealt with the incident and the teacher has been informed to not contact me in anyway unless she go through the principal. In September 2011, I withdrew my child from the school. I learned yesterday this teacher has been calling people I know to try and find my information with threats to take legal action if I don't talk to her.

I need to know legally what I can do to stop her and if I have legal ground to press charges on her?

What are the legal steps I should be taking at this time?

Perhaps you should start out with reversing the horrendous "advice" you have given your child that she should lash out with violence in response to a teacher attempting to enforce legitimate rules.

There's nothing you can do. If the statements she is making are true, then she has done nothing wrong (unprofessional, maybe, but not illegal).

There's nothing you can do. If teacher files a complaint, get an attorney for your child.

And I agree with Zig. Stop teaching your child that violence is the answer.

My child didn't hit her. This is what another teacher told the principal which is why they didn't know for sure what happen.

I never told my child to hit anyone I told her to walk away which is what she did. The teacher got suspended for a week because she touched my child when she was leaving the room, getting away from a fight.

You really ought to word the post differently then...

yes that certainly does say mom told kid to leave the class in any way necessary, including violently.

So the issue has been dealt with by the school? Good.

What are your damages?

Perhaps the teacher is wanting to sue for your child assaulting her.

My new policy is that we oughta close down ALL the public schools. Let the parents teach their own kids, or they can band together and create small schools where they can control each and every moment of the child's day.

If parents teach their own kids, no one can ever get near their child to touch him/her for any reason.

Well if it's dumb advice it saved her twice.

I told her to go to the front office.

When a teacher leaves the room anything can happen.

From what I can gather, since there are different stories, the teacher wasn't in the room for awhile, something happen in the room, my child left and the teacher grabbed her from behind.

My child didn't see the teacher and the second teacher confirmed to me that my child was grab from behind.

GREAT!! A teacher to help her !!!

Kick her, the teacher, the authority to help her.

your child should be charged with a felony. assault on a teacher.

That doesn't change anything. There's nothing you can do. Drop it and get on with your life. And stop giving your kids bad advice.

All teachers oughta quit teaching in public schools and simply teach their own kids. Perhaps they could also teach their nieces and nephews and grandchildren.

Then those such as the OP (and associated ilk) can "educate" their own children.

Survival of the fittest. Massive social experiment.

I will add this to the list of topics of books I should write.

Don't need anymore advice. I'm talking to a lawyer now. According to him she had no right to touch my child and as long as I got the second teacher as a witness and the fact I could never got a straight answer from the school/principal means I have a case, if I need to go down that lane. According to him this could be deemed as stalking/harassment on her part.

To Banned, I hope this same situation happens to you and your child.

To Mistoffolees, I did go on with my life. This happen in August, I withdrew my child in September, the school punished the teacher for what she did, its now October and she has been trying to contact me through other people.

books I would certainly add to my reading list.

I would not like to take part in the experiment tho, I love sending lil honey to school. I don't have the patience teachers have, I could not teach her anything, except how to behave in school.
