How long for FoC Investigator's Custody Report?

What is the name of your state (only U.S. law)? MI

We had a meeting with the investigator over three weeks ago (I'm CP. NCP is asking for custody). I've been waiting on pins and needles for her report to be sent.

How long does this typically take?

I have a second question, too.

How can I prove that dad was at son's football game today? What would the court look at as being proof? A cell phone picture wouldn't work, because the date could theoretically be changed, right?

Reason I ask is in case the custody matter winds up in front of a judge. Dad's contention during the investigation process was that he needs to be the CP to better support son's schooling. Two days after he said that, he did not come to curriculum night at the school. As of now, he's not been to parent teacher conferences, which end tonight. And given the fact that he's never gone in the past, I'm thinking he won't go tonight.

I suspect he'd lie and say he couldn't make the conferences. I want to be able to show he was at the game for the fun part of parenting, but didn't show up for the educational part which he made bold claims about being better equipped to support.

Is there anything I can do to prove he was at the game today if it became prudent to do so? *I've got the principal getting copies of the teacher's sign in sheets to prove dad was not at conferences if it turns out to be the case. I just want to be able to put him in town and available to have gone.

My ex NEVER goes to Parent/Teacher conferences, and NEVER goes to back to school nights. He also NEVER goes to their extracurriculars. He was still able to get custody of the girls.

And really? *I don't consider going to a football game the 'fun' part of parenting. I can think of 10000 things I'll do with my Friday nights once my kids are out of school, that don't involve sitting through a football game.

After fourteen years of my having custody, if he's gonna proclaim he needs to have custody because he can better manage son's educational years and wants to buck status quo, I'd think he should do everything he can to put some actions behind his words. Can't be a better manager of school when you haven't been to curriculum night or conferences.

I know the investigator felt at least some of the same way. I know she "gave him hell" for not ever having reached out to some of the professionals that work with our son before the meeting.

But let's go with what you said. Let's say I'm reaching. Any answers for the question? *Game starts soon.

If you've had 14 years of primary custody, then you're wasting your time on stupid things like whether Dad went to a football game. Dad will have to show a change of circumstances to get the court to even hear the matter. And then he'll have to show significant justification for a change. If you don't understand the basic principles, you should get an attorney.

Get on the PA system and announce to the entire crowd that you want them to look at the person in seat 17B because you are going to subpoena everyone in the stadium to have them testify that he was at the game. You will be walking through the crowd to get everyone's name and phone number. :rolleyes::rolleyes::rolleyes:

And, frankly, I'd rather go watch my child play football than go to the school's curriculum night, too. I've been at enough of those to know that they're generally a total waste of time.

Let it go. It doesn't mean anything - and will only make you look foolish.

No answer for the football game question, sorry, just way to much that I am no expert at as far as what would be let into court and what would not. No experience whatsoever with that.

The FOC investigators report, in my county usually takes about 4 weeks. But I have seen then come back in 2 weeks. However my county tends to be some what faster then most. Typical time for others would be more like 2-3 months.

I just posted on this in another thread, does not apply in all areas of Mi. And in this posters case, it has already started to be heard with or without a change in circumstance, as she is waiting on the FOC investigation report. That means the court is hearing this case. You do not need a change in circumstance in Mi for the case to be heard, investigated and ruled on.

With that being said, 14 years of primary, dad will need to prove significant justification for a JUDGE to change it. I put Judge nice and big because a Ref can change it without and they do, so OP needs to know that Ref's only make recommendations, she has the right to object to a Ref, to a FOC investigation report and be heard by a Judge.

If I remember correctly though, there is some posting hx here. Mom might have given dad that significant change for a Judge to change it.

But OP's case is being heard, it has gone through a FOC investigation, that means it is being heard.

I would rather go to the game to. And I would just skip this part also, just cause dad is not going to that now, does not mean he won't if he had custody. I have heard Judges say this same thing. Focus on asking the court what dad's plan is to manage the child's school. And after that is presented, ask how that is better then what you have been doing and ask why it can't be done as custody stands now.

A lawyer could tell you all this and put it way better then I and argue it way better then you or I. But your posting hx OP might have something even more important to have a lawyer for, if I remember correctly.

And Mom? Take the picture. It's not likely to make any difference at all in court whether the date 'could' be changed or not.

If someone can't be bothered to put all their information in one thread or, at least, explain all the relevant history or provide a link to the earlier thread, I'm not going to do all their research for them. My advice will be based on the information in the thread that they just started - and if it's irrelevant because they left out all the important stuff, that's their problem.

Choosing what to include is easy if you stop opening new threads every time you turn around. Then the volunteers could see your history without having to dig for it.

Actually, that would be useless. That paper would be inadmissible.

That's not actually true. The admissibility of evidence such as cell phone photos, etc, would be very much linked to the credibility you've established with the court.

Actually, you are the one who is confused - as you've been told repeatedly.

I specifically stated that if you were to go through the crowd, you could get names and phone numbers SO YOU COULD CALL THE PEOPLE FOR THEM TO TESTIFY. The list of names and phone numbers would be useless. Their testimony would matter.

I obviously knew that you didn't have such a paper - but was simply pointing out that you do not know what you're doing and are likely to dig your hole even deeper with your messing around. Your post confirms that.
