Public Adjusters

What is the name of your state (only U.S. law)? PA.
Hi, I need some help here. Last January, I noticed that my carport which was attached to the house was coming down. Not being certain as to what is and what is not covered, I called a Public Adjuster who a friend recommended and asked them to come out and look and see if this was something I could claim or not claim. When I got home there was a contract in my door stating that they felt I had a legitimate claim. So I signed the contract and emailed it back to them. It wasnt until about 2 weeks later I found out they submitted a hail claim from my insurance company. I called them and asked what about the carport which is what I called them for. They submitted another claim for that as well indicating it was covered under snow and ice. When the insurance company came out and looked at it with the owner of the Public Adjuster’s firm the Public Adjuster pulled the claim.

I then get a letter from my insurance company saying I have to repair the carport within 45 days to keep my insurance. That cost me 4000.00.

To date my insurance company thinks that the damage to my siding and roof isnt greater than my deductible and I can hardly get the public adjuster to talk to me.

I did file a complaint with the State of PA’s Insurance Commission and waiting on their findings. I was also to ascertain from my insurance company that there was correspondence between the Public Adjuster and the Insurance Company that the Adjuster failed to send to the commission. I have forwarded it to the individual at the commission who is handling the complaint.

At this point I am out over 4000.00 and this Public Adjuster is obnoxious and accusing me that they told me 2 years ago that the carport wasnt covered as I had them come out 2 yrs prior to look at my garage and they told me that the garage was not covered and I never filed a claim.

The firm sent out a new adjuster who basically doesnt totally know what he is doing, and the owner of the firm is trying to push it back on me.

Do I have any legal rights to sue the public adjuster for failure to do their job? If so any help on how to go about it would be appreciated.What is the name of your state (only U.S. law)?

how did your carport actually get damaged? was it just old, or did something fall on it?

what actually happened to the carport. did something fall on it, or was it just old??

It was old but not being an insurance expert that is why I called the public adjuster to see if it was something that would or would not be covered.
You think insurance would cover your lack of care and maintenance? Really? :rolleyes:

The thing is I didnt know if it would be or not covered. And the contract I signed which I thought was for the carport was for a hail claim. And the public adjuster never told me it was a hail claim for my siding and roof. I found out after I received a letter from my insurance company saying that if I needed them to tarp my roof in the current weather conditions to prevent further damage. That is when I found out the adjuster didnt even look at my carport which is what I asked them to do.

Since that time they are now accusing me of being dishonest and misrepresenting stuff to them, when in fact had they come out and looked at what I asked them to look at and if the individual who came out to my house knew what he was doing, he would have said no it isnt covered and I would have been done with them. And it would have been the end of our business agreement. But as I put in the original post it is not at this point.

So now I am at a point that due to their errors and screw ups, I had to put out over 4,000.00 in repairs in a 45 day window to keep my homeowners insurance. And when I received this notice from my insurance company and I called the adjuster she basically just laughed and said looks like you will need to get new insurance then.

And in todays current economic environment that is much easier said than done and I could not afford to be paying another company premiums when I had already paid my insurance with the current carrier for the year.

The contract only had a date of the event on it. Did not say it was a hail claim and the adjuster wrote on the top of the agreement as it is as minimal as the state requires "we feel you have a legitimate claim".

I read the contract. it wasnt much to read to be honest with you. Very minimal information and no details as to where the damage was or what type of damage.

I am asking for assistance here based on experience or similar experiences. I am not asking for smart comments. Thank you

The adjuster did their job.

You need to bring your property up to acceptable standards (to the insurance company.) If you do not, they will cancel.

How did the public adjuster do their job and file claims that were not legitimate claims. I brought my house up to standard for the insurance company. My issue is they filed a hail claim when I merely asked their opinion on the car port and never told me they were filing a hail claim. And after they filed the hail claim the public adjuster told me the damage was estimated at 15,000.00 and my insurance company says it isnt over my 1000.00 deductible. This doesnt make sense unless the public adjuster has no idea what he is doing.

Ok, let's say he DIDN'T do his job.

How does that change things?

You requested that the insurance company come out to inspect your house. They did so. Your carport was not a valid claim, but the hail damage was. Seems to me that the adjuster actually did his job and more.

YOU violated your contract with the insurance company, and they graciously gave you 45 days to correct the problem.
