Hello, I live in California. I attended a private nursing school. They had certain passing requirements. They changed the passing requirements mid-program. Should they have waited and changed the requirements for the new group. Due to those changes, I got kicked out of the program. Is this legal?

Bolded the first: They are private institution. Thye can do whatever they would like.

Bolded the second: Yes, perfectly legal, unless the contract you signed with them when you enrolled states diefferently.

They actually changed it in my school where you can have a strong grade in the class throughout the class and have a test that a third party writes, which is pass or fail. Some people had an A in the class and did not pass the third party exam at the end and got kicked out. I had a B. The original passing requirement was getting a 73% in the class. They changed it to 76% 7 months into it. That is fine. Then they added passing a third party exam in a pass or fail format for the entire class. You could have a strong grade throughout and fail the last test and you can't do anything about it. In the end I had a 77% in the class, so technically it was not due to low grades.

Wow....the LPN/RN programs up here require students to maintain grades at or above 80% or risk being eliminated from the program.

Raising standards for health care providers and utiliizing third party verification of knowlege???? Good things for the medical field.

I'm just wondering if this is a case worth fighting for, or to just let it go. I don't want to fight a pointless battle that I won't win. It was an RN program and I only had 6 months left to finish.

I realize that the standards should be high. It is not that. It would not bother me if I started off with needing to get 80% in the class. That would be fine and understandable. Since they changed it midway, I just want to know if it is legal or worth fighting for my rights is all. I don't want to do anything, because I don't think I have a case, but my family wants me to do something about it. If there is a person who works as a lawyer or a legal assistant out there, can they please inform me if I have a case to just let it go. This all I ask.

No one can tell for certain what recourse you may or may not have without nowing what your contract with the school states. That is your first step.

AS a rule, private companies can make and change their rules as they see fit.
