Does it say "any disputes to be settled by XYZ procedure"?

No one cna tell you if a case exists or not without the contract.

I'm just wondering if this is a case worth fighting for, or to just let it go. I don't want to fight a pointless battle that I won't win. It was an RN program and I only had 6 months left to finish.
**A: and what documentation and proof can you provide that proves by the preponderance of the evidence, that the school somehow caused you to get bad grades and not fulfill the new passing requirements? Are we missing something here? How is the school to blame for your low grades? Are you not responsible for diligently studying, turning in your homework and passing your exams?

No one can tell you if a case exists or not without the contract.
**A: are you somehow refering to the Nyah, nyah, nyah alternative dispute resolution (ADR) clause mentioning binding or non-binding mediation and then arbitration?

They actually changed it in my school where you can have a strong grade in the class throughout the class and have a test that a third party writes, which is pass or fail. Some people had an A in the class and did not pass the third party exam at the end and got kicked out. I had a B. The original passing requirement was getting a 73% in the class. They changed it to 76% 7 months into it. That is fine. Then they added passing a third party exam in a pass or fail format for the entire class. You could have a strong grade throughout and fail the last test and you can't do anything about it. In the end I had a 77% in the class, so technically it was not due to low grades.
**A: In my book, 77% is a low grade. And 100 degrees is a low grade fever.

honestly all I did in that class is study and nothing else. The program is accelerated, so it is meant to go fast. I did work on the side, but not too many hours. I was able to handle it and took a week off before my final to devote to studying. I have to study hard to learn.

I dont remember signing a contract. I do remember signing a contract for financial aid and do have a signed copy of that one.

**A: but despite your efforts, that still was not good enough. Can you transfer your credits to another school and finish up?

Then, is it possible that you simply weren't retaining all the info?

I don't mean it to be harsh, but some students simply can't cut it. Espeically in accelerated programs.

And it takes some very good students to move through an accelerated program, and it is often nearly impossible to be successful doing so while working.

I have worked in the medical field and witnessed examples of this in accelerated RN, RT, CRNA and Paramedic courses.

You signed more than simply the fin aid.

Espeicially in a medical program; I can think of several:

  • Agreeing to participate in practicals and abiding by the facility's requirements (uniforms/conduct/etc).
  • Maintaining patient confidentiality
  • Student code of conduct
  • Honor code
  • HIPAA disclosures

Find it, or you might try asking the school.

But it ultimately comes back to the contract.
