What is the name of your state (only U.S. law)? Michigan


In January, my 16 year old daughter assaulted me and a sibling. In the past, she also stole and totaled my vehicle. She was placed in detention, then into a residential treatment facility. The court now wants her back home. As victims, do we have any rights? We have no wish to abandon her, we just don't want to live with someone who has repeatedly committed crimes against us.

Sure get a restraining order against your daughter.:rolleyes:

You can't have it both ways, either you abandon her or you welcome her home and get her the help she needs. In fact get the help your whole family needs.

I can't think of anything less helpful than your answer. We have had a great deal of "help", but are dealing with a child who has limited cognitive abilities and a severe mental disorder. We are not "trying to have it both ways"; we are trying to make sure we get the help for our daughter that she desperately needs while protecting our other children.

I hope you are never in a similar circumstance.

Does your daughter have an IEP and is (was) she receiving special ed services?

Why is she being discharged from the RTC? Who funded her stay?

I have been in the SAME circumstances. It is a horrible place to be. And yes, you can be a good parent with your violent child living elsewhere due to the safety of all.
