What is the name of your state (only U.S. law)? From South Carolina.

My wife and I have been at odds with each other for 2 years now and it's come to a head. My wife is controlled by her mother and events have recently occurred that have forced my hand with things. I have been unemployed for nearly a year due to illness and have been looking diligently and going to school online. Things got ugly one night and i left for a night so things wouldn't escalate. I came back home to find some of the pictures, furniture, my computer missing. she apparently took my credit card, my car and most important of all, my children. next day i went to see my daughter at school and couldn't see her because of fears that a situation may arise, ect, ect,. I haven't had time to do much of anything. I'm currently staying with my mother who lives close by and have returned to my home several times only to now find out that she has moved back into the house, changed the locks on the doors, and of course, i have no key. Her and I are still have our names on the house and I feel she is moving too quickly on things before the dust even has time to settle. I'm trying to find out what my rights are and who can help me with this even though my financial status is somewhat nebulous. Can anyone point me out in the right direction before I lose my mind? :-(

Assuming the children were born when you were married, you have every bit as much right to see them as Mom does. You can pick them up at school, etc.

You do NOT want to get into a situation where there might be an altercation. If, for example, you wanted to go to where Mom is staying to see the kids, you should bring another adult along as a witness. If things start to get hostile, leave immediately.

If you end up getting divorced, then you can ask for temporary possession of the marital home. You can ask for temporary custody or a temporary visitation order. You can even ask for temporary support.

She of course can also ask for the same, so since she can pay for the house and utilities and you currently cannot, it may be pointless to ask for temporary possession of the marital home.

My son and daughter were born during our marriage so that's the least of my worries I'm supposing. Trouble is finding a lawyer who can work pro-Bono for me until i get a job is a real pain in the rear. does anyone know if a lawyer can be provided for me if i decide to take this to family court?
