I currently a resident of New Jersey.

I got married 7 yrs back. I and my wife were staying in US for the past 5 yrs. Everything was going good 2 yrs back she had an affair which I got to know about an year back. Now she has moved to India ditching me.She has taken all my savings. Not sure how to get my savings back and how to get her to US so that I can proceed legally against her. Father in law threatening me with all lies. My wife wants a divorce in India now and she does not want to return my money.
Any help is appreciated.

Close the joint savings account. Do not expect that she will pay it back. However account for it as a marital asset. You can sue for divorce here. Serve her by mail. Why does she need to be in the US for you to get a divorce?

Married 7 yrs ... now she steals all of your money and absconds to India. That's a bummer.

Are you Indian too? I don't know if Indian law would offer any relief ... US law would be a big hassle with no guaranty of recovery.

Mean father-in-law? That's a surprise...change your phone number.

Chances of getting her ordered back to the US: zero.

I agree with all of this, but if I remember correctly the courts in India will not recognize a US divorce. Therefore, if he ever intends to live in India again he would have to get a divorce there.

Even if he doesn't intend to live there, he may want to talk with an attorney in India. He might have a better chance of recovering some money there. Of course, that assumes that he CAN file in India, but talking with an attorney there would answer that question.

What have you done to her that caused her to behave in such a manner?
