What is the name of your state (only U.S. law)? Texas


I am divorced. My ex-wife and I proceeded with a standard Texas Divorce. Pretty simple and easy everything has been ok for the most part. Well now when she gets mad at me for whatever reason, she stops letting me speak to the kids and seeing them even when its my time to have custody ie everything Thursday during the year, and every 1st, 3rd, and 5th weekend. Now I want to see more custody of the children ie maybe a Tuesday and another day if possible on weekends I don't have them, they are my world. Is this something that can be done or will a judge think its crazy or too much disruption to their lives.

You're probably not going to get the custody schedule you want unless your ex agrees.

However, if she is denying you the court-ordered visitation, you can file for contempt. You should certainly be able to get whatever the order says you should get.

So bacially there is nothing I can do if she does not agree? The judge wont sign off on it at all?

What if she cannot afford a lawyer for a matter like this? One is nto appointed for something like this is there?

You can TRY, but you're already getting close to the state guidelines, so your odds of succeeding over her objections are slim. AND, you might end up paying her legal expenses.

I don't know, but it won't matter. First, you need to show a change in circumstances to get the order changed - and you don't have a CoC. Then, you have to show why the change is in the child's best interests (with hard, provable facts) and I don't see any way you can do that. You're just not going to get what you're asking.

As I said earlier, you can file for contempt if she is denying court-ordered visitation.

There is no way that a judge is going to give you time every weekend, so you can forget about that idea. The children deserve full weekends with both parents.

If mom is denying you your court ordered parenting time then the solution to that is to take mom to court for contempt.
