Wife trying the 1 - 2 Punch

I and my (STB EX) Wife are both Military and stationed in Hawaii. I returned from deployment last year and she is in the middle of one now. We have two children, My Stepson who is 12 and my Daughter who is 2. We agreed to have a divorce this last June just before her deployment after a big argument that saw both of us removed by the MP's after I called them because she was blocking my withdraw from the house to "cool down"

Things were going good for the last few months I was using our shared income to pay down bills and back debt incurred by her during the marriage all with her permission. We were to stay married until she returned this next June and file for divorce and then have our custody hearing for my Daughter.

She returned early for Leave without informing anyone back here showed up to the house with her Rear Detachment chain of command and accused me of Child Abuse and Neglect towards my Stepson. She tried to have me kicked out but because I am married to her and we share Army housing even though I am not in the Lease I didn't have to leave. I voluntarily left the house for the week and was going to stay at a friends to avoid a worsening situation.

After a supervised meeting between the two of us held by our units we talked over finances and such. She informed me that she wanted full custody of my daughter and everything else citing these accusations. After informing her that they were false I said I would agree to joint custody but she flatly refused. Two days later I was served with a Temporary Restraining Order on the grounds that I abused her, my stepson and that she was worried that if I was to visit my Daughter I would flee the Island with her.

I am scrambling to come up with the money for a lawyer to help me through this case but after having to get an apartment and such I'm tapped on money. I find out this weekend from friends that still live near my house that she has moved the kids some place else that no one knows where, she is moving stuff out of the house and has basically abandond my Dog in the back yard who my neighbor has been. Giving Water and food to Since I cannot return to feed him or collect him up.

I am getting hints from people back on the mainland that she is getting ready to move them to. Seattle before leaving to go back to deployment. Does anyone have any advice hit his situation. I want custody of my daughter due to the fact that I think she would be better off with me then her mother as her mother has already left her son with other people for most of his life as she in her words "is unable to deal with him"

I know she couched him into what to say over the phone before she got here as both myself and the sitter both over heard phone calls of her leading him down questions and pushing until she got the answers she wanted.

Any advice or help would be great. This is the most stressed out I have ever been in my life.

You need to see an attorney. This is not something that's going to get solved here.

Your attorney may suggest that you ask for a GAL and/or a counselor to talk with the boy. You will probably need to subpoena the babysitter.

Can he do that? The child will not be part of the divorce. If there was an investigation CPS would talk to the boy, but I don't see how a GAL or counselor could be appointed regarding that child...or at least not outside of a CPS investigation.

A GAL or counselor could not be appointed regarding the boy, but a GAL could most certainly be appointed regarding the girl - and the GAL could talk with anyone in the household.

A non party adult could decline to speak to a GAL. I am pretty certain that a GAL could not speak to a child who was not part of the case unless all the child's parents approved. I don't think that I would approve of dragging a child who was not involved into the case.

Again, its different if CPS is investigating.
