What is the name of your state (only U.S.Ga law)? my wife went online. And talked to young man(23) she is (50). Told this man she is 27 has a child that is 8 months old, and sent him a picture of her daughter who is 27 and has an eight month old baby. Well she kicked me out changed the locks. Telling me she cannot be herself around me. I can't afford a lawyer I'm a heart patient, and diabetic. She has insurance on me which will be cancelled. We were only married a year. And from listening to her I am sure she did this same thing to her ex-husband. He was a fire man so he was gone a lot. I do have the email proving she sent the email. She don't think it was wrong just 15minutes of craziness

File for divorce. Once you do that, cancelling the health insurance on you will be a major no no.

If she has insurance through her job, she can't cancel it except at open enrollment or within 30 days of the divorce being final. Once it's cancelled you will be offered Cobra, which will be expensive. If you are disabled, you should be filing for disability and medicaid.

That is absolutely true. File for divorce ASAP. Not only will it protect you from having her cancel your health insurance, but she will not be able to throw you out of the marital home. You may also be able to get temporary spousal support.

Furthermore, there was nothing posted to state that the OP doesn't have plenty of his own income.

You're right - I don't know anything about their relative incomes. I just assumed that as a heart patient and diabetic who can't afford a lawyer that he wouldn't be making much money. Could be wrong, though.

As for the support, even for a short term marriage, there is sometimes temporary support awarded.

But both comments are the reason I said 'might'. Without more information, it's impossible to be sure one way or the other.

OK, you've got your answer. File for divorce and she will not be able to cancel your insurance. She will also not be able to throw you out of the marital home, although you may not want to stay there, anyway.

If you're making a reasonable living, temporary support isn't all that likely, although '$15,000 more' doesn't tell us a lot. If you're making $15 K and she's making $30 K, your chances for temporary support would be better than if you're making $200 K and she's making $215 K. Still, even at the lower end, it's not all that likely.

You have only been married for a year. How did you cover your meds prior to your marriage?

It is or is about to be open enrollment for about half the country, if not more.

This is not my area of expertise and I have not had employees in GA since 1999. Is there a law in GA that once a divorce is filed, the partner with insurance cannot remove his or her spouse from the health insurance even during an OE period?

I haven't checked Georgia, but every state that I'm familiar with requires that neither party make any major changes involving insurance while the divorce is pending.

OE really doesn't matter most of the time. For most insurance plans, once the divorce is final, they can remove the ex.

i was married before my wife of twenty years.She passed away. That was two years ago. After being bedridden for a year. with me being her care giver. I was not able too work a full time job. So we wre able to get our meds at a discount. i also lost my home of seventeen years to forclosure.
