Bitter Wife want Allow me to see her our Daughter,I need some Advice

What is the name of your state (only U.S. law)? Virginia. My wife and I separated 4mths ago while she was pregnant with our daughter and has since given birth to her. My wife moved back to Texas where we are both original from when we separated. She is extremely bitter with me since I was the one who decided I was unhappy and wished to file for divorce. Being I’m military she’s always contacting my leaders and filing complaints on me that aren’t true just to keep pressure on me. I’m required by the military to give her part of my basic housing allowance and pay her in the amount of $645.30 When she gave birth to our daughter I took leave and bought plane tickets to be there to see her birth. However, my wife refused to allow me to be there when we talked over the phone the night before and I explained to her that I didn’t want to mislead her in anyway while I was there and cause her more pain. I explained that my purpose for being there was to welcome my daughter into the world and handle her health care issues and that I had no plans on trying to work our marriage out. She didn’t like that at all and at that point said if I showed to see my daughter she’d have me removed from the hospital and get a restraining order on me. I wasn’t sure what she could or couldn’t do and decided it was best I didn’t go at the time cause I do know her and if there was any way she could prevent me from seeing my daughter she would. She refused to send me pictures or answer my calls for about two weeks .She has since sent me pictures but is still very angry and calls with threats saying I’ll never see my daughter that she going to take her to Mexico or that she going to move her to Germany with some family .I’m planning on returning to Texas to visit my daughter and file for our divorce this upcoming month but I feel she’s still not going to allow me to see her. Is there anything I can legally do to allow me to see my daughter being we are still married? Or will I have to wait until we get some sort of legal custody agreement? Even though I was unable to attend the birth my wife had me put on our daughter birth certificate. Also, being that I ‘m military my daughter needs to be filed on my health care plans and she refuse to send me my daughter’s birth certificate or SSN card so that I can place our daughter on it. But she calls saying my daughter needs to be on my health care to see the doctor. However, I’ve contacted my health care and they cannot add my daughter without the original forms which my wife will not send me even though I’ve explained to her that I have to have them. She refuses to give me anything because she thinks somehow this is going to benefit me in some way? I plan on hiring an attorney but I’m just looking for any information that anyone can give me that might be helpful until then.

fastest way to get the child insured? give mom the contact information to your provider. and authorize her to allow them to speak to her. she can fax, mail, scan stuff all on her own. you don't need to be the go between.

is she being a butt about it? yes. but let's get past it.

you can file for divorce. being you are military, i'll let others refer to you as far as jurisidiction goes.

yes, you can file for temp orders for visitation. however, being that it is a newborn, you are looking at some supervised visits. maybe with mom, maybe with a family member. this has NOTHING to do with you or your status as a father. it has to do with the child. a new baby. so please don't take it personal if those are ordered. it's not really YOU being supervised, but the child's comfort. they really need to come up with a better term for that for these situations.

She is MARRIED to you. That means that you are PRESUMED to be the father. :cool:

Contact the hospital directly and see what they can give you in regards to your daughter's birth.

Order your own copy of her birth certificate.

Order your own copy of her social security card.

You're entitled to those documents and your wife isn't the only way to get them. Do the footwork, dad. Be proactive.

You only have 30 days from the birth to add the child to your insurance. Better get moving on that.

So, it's COMPLETELY logical that Mom might not even HAVE the paperwork which Dad supposedly requires. It took almost 6 weeks to get Twain's BC from the state. I can't even remember if I got the SS card first or if it took even longer.

I was just truley unhappy with my wife.
Here's the bonus non-legal input. You were apparently happy enough with your wife 9-12 months ago to impregnate her. For the sake of your child, I would suggest that you (both) consider giving some marital counseling a try.
 
With the military you have more than 30 days to have child placed on insurance.

Dad you can get this information yourself

Apply to get a copy of social security card and also apply for a copy of birth certificate.

Since you are still married to Mom your name is automatically placed on birth certificate as presumed father.

Your wife can call Command and make requests but your Command has the option whether to listen to her requests.

If your wife is in TX more than 6 months divorce should be filed there if she has not been you can file in Virginia.

Divorcing in VA with a child in the picture, requires 1 year of seperation, then you can have your divorce.
