Trying to finalize a divorce

My fiance has been trying to finalize his divorce. She agreed to sign a marital settlement agreement to get this finished but when he gave it to her to sign she now refuses. In January of 2010, almost 1 1/2years after he started the divorce, she finally filed her response to the petition. She only filed this because she was going to be defaulted on. He then in turn filed his proof of service of his Disclosure of Income and Expense. He has been waiting all this time for her to file hers. Neither her or her attorney will do it. We just want this over with so we can begin our lives but we don't know what to do now. We are not sure if we can just request an entry for default judgment or not.

Were YOU married to her, also?

If not, then there is no "WE" in this matter.

For your information I am not a mistress. They have been legally separated for over 3 years!!!!


FYI, you don't have a fiance.

But that aside, he should speak with an attorney - I'm not convinced he's really able to deal with this himself.

When one party in a divorce has an attorney, it is ALWAYS wise for the other party to seek counsel themselves.

Always. All ways, too.
