moved from TN to GA

What is the name of your state (only U.S. law)? GA (just moved from TN)

I am in GA having just moved from TN 2 weeks ago. my wife and I could not get a divorce in TN because we were still living in the same house while it was on the market.

now that we have moved to GA

1. could we get a divorce if we are living together in GA

2. if we are not living together could we get a divorce right now or would have to wait a certain amount of time as new residents of the state of GA.

One of you must live in GA at least 6 months before filing.

If you live together, you can not use the no-fault grounds for divorce, so you'll have to go through the greater expense and delay of a divorce based on fault.

Sorry, but your story doesn't add up. You just moved from TN to GA 2 weeks ago. You claim that your stbx has been living with her BF in GA for 6 months. Yet you're also claiming that you're living with her in GA.

1. You could have filed in TN after she moved out.

2. You could have filed in GA at 6 months if you she was living separately.

How about a specific timeline? Who lived where, when, and with whom?

lived together in tn till jan 15th 2011

she moved to ca from jan 15th till to july 15

she then moved to GA till august 15

from august 15 till 2 weeks ago we lived together in TN

we are temp living together in GA

Then your only option is to file in GA (or move again). That means either a no-fault divorce (which means that one of you will need to move out) or a fault divorce.

we are not going to be living together for more than a few more weeks.

the truth is, she cheated so I could make a fault divorce but I am trying to go for what is the easiest to get it over with.
