My ex wife told me today that she is planning on filing with the courts to have our daughterswho lives with her last name changed to her maiden name. Can she do that without my consent? We live in TX.

Fixed it.....No she cannot do that without your consent or by court order assuming the daughter is yours and born of the marriage.

I agree, that is a good example of a case where it "might" happen. Another example is if the parent committed a very heinious (sic?) crime against the child, or is incarcerated for life. Of course, in that case the parent's rights would often be terminated as well.Example:
Mom reverts back to maiden name after divorce, and there's a newborn who carries Dad's last name. Dad goes awol and ignores the child's existence for the next couple of years. It wouldn't be impossible for Mom to file and have the child's name changed to hers even if Dad (once notified) objects.
Or...dare I say it...to that of her new husband....
