Mislead by Paralegal

We asked a Paralegal if we should transfer the house deed to my cousins name due to the law of if you use government funds, such as SSI, they take it off the house. The paralegal never stated the taxes would go up at all after the papers were signed. We are now stuck with 16,000 in back taxes and someone who refuses to put the home back into his mothers name.

So...In the attempt to defraud the Federal Gov you were misled? Do I have that right?

No, that's the issue, she advised to put it in someone else's name but did not give my aunt or cousin that reason or advise of what that was actually doing when my grandmother passed. She knew my aunt was stressed due to the lost and didn't want the home responsibility at that time but didn't give all details, she had no clue until after.

The paralegal played dumb at that point and said she learned something new- 1. the law that involved the gov't 2. Taxes would be 3x or more higher...

did you ask if the taxes would go up?

if this was your grandmothers house and it was transferred due to her death, the grandmother's taxes were likely to be artificially depressed due to the home being listed as a homestead and/or the tax increases were suppressed for some other reason by the state so when it transferred, it is now taxed on it's full value.

how is that the paralegal's fault?


and you were trying to defraud the government if the sole purpose was to set things up so the government could not claim against the house.

Also, I am not sure if you ever had a great loss in your family but legal terms and why things are done at the time are not top priority. IF a paralegal states something is legal and has to be done, hmmm, you'd probably listen.
