Can my daughter move to another county?

What is the name of your state (only U.S. law)? SC

A few weeks ago my 12 year old daughter became very violent, and I had to call the law. She was not taken to jail, nor were we given any papers showing her charges or anything. The officer said that she was going to be charged with assault & Battery 2nd degree. There is no court date set. She wasnt even fingerprinted. I called the officer today to find out if my daughter could go to stay with my mother til her court date. He told me that there isn't any reason why she can't go, but that I may need to call Family Court first. Is there any law saying that she has to stay in this county? And if we weren't provided with any paperwork is she really charged with the crime?

Assuming both parents agree, there is nothing stopping you from sending her to stay with Grandma until the court date.

I have to wonder what precipitated this all. Kids don't normally just go berserk with no warning. Or has this been an ongoing situation?

What else is being done to get to the bottom of this? Is she in therapy? Has she been seen by her physician for a full work-up? What have the parents done to find out what is going on?

Actually there could be. Some of the default instructions when she is charged may REQUIRE her to reside with her parents or in the charging county. They may need to get permission from juvenile court to send her to her grandparent's house.

I am not disagreeing...


However, it seems that the OP doesn't even know if the child has actually been charged with anything.

And that would be the first step I'd take. Contact the prosecutor to see if any charges are being filed and if there is any restriction on the child leaving the area.
