I have a pending re-opened case in Nevada, where my husband made an annulment by a way of fraud in 2009. I filed a motion to set aside Order and have next hearing in a few months.. I was never served with any documents regarding my husband’s fraudulent annulments. Now he wants to kick me out of the marital house (where I have been living with him since 2005) and to take a car away from me. . I also filed a divorce in California recently. He threatened me he would take my car away from me if I continue to file something else. I am 7 month pregnant and I am afraid he takes my car away from me (it's on his name though it was bought during our marriage and I always have been driving it. What can I do to protect a car from him, I need it very much as I visit doctors and go for food. A am alone and I am afraid of him. I filed restraining order but a judge did not find enough evidenses for that. I am afraid of him, he abuses me mentaly very hard but this is not a reason for restraining order. What can I do to stop him take my car away? I need it very much now. I do not sleep nights because afraid he comes and takes my car. He hid from Nevada Court community property and left me without any portion of community property and social benefits as his wife.

Is he the biological father of the baby you are carrying, the one for whom you need the marital car to get around? Did he use MARITAL funds to purchase the car (regardless of the timing of the purchase) or non marital funds? When was the annulment granted?

In which state do you reside and where is the car and home? You filed in CA? Is that where the property is?

Both CA and AZ can't simultanously have jurisdiction over the same divorce.

What does that mean? He yells at you, calls you things and doesn't talk nice?

Has he ever struck you or laid hands on you in a threatening or hurtful way?

Yes, he used marital funds to purchase the car.The annulment was granted in 2009 but I first found out about that in 2011. He beg a person who discovered his fraud say nothing to me about his annulment.I am in CA, the car, the house are at tha same place. My husband and I have been residents of CA since our marriage and never moved from the marital home anywhere.I am still in the marital home.

He threatening me he woild take the car,his words and actions made me deep mentally suffering with feelings ofhelplessness, worthlessness, anxiety and depression. I have OCD and I am pregnant. His words and actions hurt me mentaly much more than physically.

Sorry but YOU have not been married since 2009. If the annulment was granted in 2009 for YOUR marriage then you are not married and a divorce is NOT necessary. You also can't file for divorce with a reopened case in Nevada. YOU need legal counsel because you are messing this up big time.

In addition, it means that marital funds weren't used to buy anything. If there was an annulment, then there ARE not marital funds. Items belong to the person whose name is on the title.

Of course, it also means that Dad has no parental rights to the child until paternity is established. And all the other things that go with them not being married.

OP needs to see an attorney. Now.

A month ago he took my car away from me and I called to police, they told me that we are legally married in California.

The car was bought during our marriage, before the annulment.
I do not have funds for attorney, my husband left me without ANYTHING by his fraud annulment. He is a rich man but a very greedy, he always hide money from me, kept me on allowance basic for all 7 years of our actual marriage.Thank's for your reply.

You don't understand. If he was granted an annulment, you were never married. The annulment says that the marriage never existed so it is incorrect to say that the car was bought during your marriage.

Of course, something doesn't add up. You stated earlier that "He hid from Nevada Court community property and left me without any portion of community property and social benefits as his wife."

If you had a Nevada community property settlement, then that would mean that you got a divorce - and a CA annulment would be meaningless. OTOH, it's more likely that you simply don't understand what's going on. Please give us a timeline:

1. When were you "married"? Where?
2. Please provide a list of states where you lived together including the years.
3. What was filed in Nevada? When?
4. When did he FILE for an annulment in CA? You said it was granted in 2009.
5. Why did not you not find out until 2011?
6. What were the grounds that he used to obtain an annulment and what evidence did he present?

That will help everyone here to understand the situation since your posts aren't clear.

First, follow the contact information that others have given you.

Then, pick up a phone and call some attorneys. Many (if not most) attorneys will give you an initial consultation for free. This will help you to understand what's going on and what your rights are. They may be able to offer ways to assist you even if your non-husband has all the money.
